I. General Terms and Conditions and Customer Information

1 Basic Provisions

  1. The following terms and conditions apply to all contracts concluded with us as the provider (Dr. Adem German Health Products GmbH, hereinafter referred to as "Dr. Adem") via the website www.dr-adem.shop. Unless otherwise agreed, any terms and conditions used by you are expressly rejected.

  2. A consumer, in the sense of the following regulations, is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or a legally competent partnership that acts in the exercise of their self-employed professional or commercial activity when concluding a legal transaction.

2 Conclusion of the Contract

  1. The subject of the contract is the sale of goods.

  2. By listing each product on our website, we make a binding offer to conclude a contract under the conditions specified in the product description. Obvious errors in price indication entitle us to contest the contract. In such cases, you will be informed immediately, and any payments already made will be refunded.

  3. The contract is concluded via the online shopping cart system as follows:

    • The items intended for purchase are first placed in the "shopping cart" without obligation. You can access the shopping cart at any time through the navigation bar and make changes.
    • After proceeding to the "checkout" page and entering personal details, payment, and shipping preferences, all order details are displayed again.
    • Before submitting the order, you have the opportunity to check and modify all information (including using the browser's "back" function) or cancel the purchase.
    • By clicking the "Buy Now" button, you legally accept the offer, and the contract is concluded.
    • If you select an instant payment system (e.g., PayPal, Sofort), you will be redirected to the payment provider’s website, where you complete the transaction.

  4. The order processing and transmission of all information required for the contract will be conducted partly in an automated manner via email. Please ensure that the email address provided by you is correct and that the receipt of emails is technically ensured (i.e., not blocked by spam filters).

  5. Please note that we only sell products in household quantities. This applies both to the number of products ordered in a single purchase and multiple orders of the same product, where each order contains a household quantity.

  6. If the goods are unavailable due to force majeure or if we cannot procure the ordered products under reasonable conditions, and these circumstances arise only after the contract has been concluded (without being our fault), Dr. Adem is released from the delivery obligation. If events occur that significantly hinder or make delivery impossible—such as strikes, lockouts, official regulations, or similar circumstances—we are not responsible for delays, even for bindingly agreed deadlines and dates.

3 Special Agreements on Payment Methods

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payments are processed by Klarna:

  • Sofortüberweisung (Instant Bank Transfer): Available in Germany, Austria, Belgium, Italy, Spain, Poland, and the Netherlands. Your account will be charged immediately after placing the order.
  • Direct Debit: The amount will be debited after the goods have been shipped. The exact timing will be communicated via email.

The direct debit payment method requires a positive credit check. As part of the purchase process and contract fulfillment, we forward your data to Klarna for address and creditworthiness verification. Please understand that we can only offer you the payment methods permitted based on this credit check.

4 Right of Retention and Retention of Title

  1. You may only exercise a right of retention if it concerns claims from the same contractual relationship.
  2. The goods remain our property until the full payment of the purchase price.
  3. If you are an entrepreneur, the following additional provisions apply:
    • We retain ownership of the goods until all claims from the ongoing business relationship have been settled. Before the transfer of ownership, pledging or transferring the goods as security is not permitted.
    • You may resell the goods in the normal course of business. In this case, you assign to us all claims from the resale in the amount of the invoice total. We accept the assignment. You are authorized to collect the claims. However, if you do not properly fulfill your payment obligations, we reserve the right to collect the claims ourselves.

5 Warranty

  1. Legal warranty rights apply.
  2. For consumers, we request that you check the goods immediately upon delivery for completeness, obvious defects, and transport damage and notify us and the carrier promptly. Failure to do so does not affect your legal warranty claims.
  3. For entrepreneurs, different warranty rules apply:
    • Only our own product descriptions and the manufacturer’s specifications are considered agreed upon. Other public advertising, promotions, or statements are not binding.
    • We may choose to provide warranty service through repair or replacement. If repairs fail after two attempts, you may demand a price reduction or withdraw from the contract.
    • The warranty period is one year from the delivery date.

2. Contract Language and Storage

  1. The contract language is German.
  2. The full contract text is not stored by us. However, you can print or save the contract details before submitting the order. After the order is placed, we send the contract details and terms by email.

3. Prices and Payment Terms

  1. Prices include all applicable taxes.
  2. Shipping costs are not included in the purchase price and are displayed separately.
  3. For orders outside the European Union, additional costs such as customs duties, taxes, or transfer fees may apply.

4. Delivery Conditions

  1. Delivery conditions and estimated shipping times are displayed on our website.
  2. If a delivery cannot be completed due to an incorrect address or unavailability of the recipient, the customer must bear the costs of the failed delivery and reshipment.
  3. Pickup is not available due to logistical reasons.

5. Gift Vouchers

Gift vouchers are valid for the entire online store and expire three years after purchase. The voucher code must be entered at checkout, and if the purchase amount exceeds the voucher balance, the difference must be paid using another payment method.
